These Terms of Service ("Terms") govern your use of the PenDate Notes application ("the App"). By installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Key Points

PenDate Notes is provided as-is for personal, non-commercial use.
You own the content you create. We do not claim rights to your notes, drawings, or checklists.
Cloud sync via Google Drive is optional and subject to Google's own terms.
We are not liable for data loss - please keep your own backups.

1. Acceptance of Terms

By downloading, installing, or using PenDate Notes, you agree to these Terms of Service and our Privacy Policy. These Terms apply to all users of the App.

2. Description of the App

PenDate Notes is an offline-first note-taking and productivity application for Android. The App allows you to create and organize text notes, handwritten drawings, checklists, and other personal content. The App optionally supports cloud sync via Google Drive.

3. User Content and Ownership

Your Content

You retain full ownership of all content you create, import, or store using the App, including notes, drawings, checklists, audio recordings, and photos. We do not claim any intellectual property rights over your content.

You are solely responsible for the content you create and store in the App.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

Use the App in any way that violates applicable laws or regulations
Attempt to reverse engineer, decompile, or disassemble the App
Attempt to gain unauthorized access to any systems or networks connected to the App
Use the App to store or transmit malicious code or harmful content
Redistribute, sublicense, or resell the App or any part of it

5. Google Drive Integration

The App offers optional cloud sync through Google Drive. By enabling this feature:

You authorize the App to access your Google Drive as described in our Privacy Policy
Your use of Google Drive is also subject to Google's Terms of Service
The App accesses only the files it creates in your Google Drive and a hidden app-data folder for sync metadata
You can revoke Google Drive access at any time through the App's Settings or your Google Account permissions

6. Data and Backups

Important: You are responsible for maintaining backups of your content. While the App stores data locally and optionally syncs to Google Drive, we do not guarantee that data will not be lost due to device failure, App updates, bugs, or other circumstances.

We strongly recommend using the Google Drive sync feature or regularly exporting important notes to maintain copies of your content.

7. Intellectual Property

The App, including its code, design, graphics, and documentation, is the intellectual property of the Developer and is protected by applicable intellectual property laws. These Terms do not grant you any rights to use the Developer's trademarks, logos, or branding.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The App will be available at all times or function without interruption
The App will be free of errors, bugs, or defects
Any data stored in the App will be preserved indefinitely
The App will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

In no event shall the total liability exceed the amount you paid for the App (if any).

10. Updates and Changes

We may update the App from time to time to add features, fix bugs, or improve performance. We may also update these Terms. Continued use of the App after changes to these Terms constitutes acceptance of the updated Terms.

We will make reasonable efforts to notify users of significant changes by updating the "Last updated" date at the top of this page.

11. Termination

You may stop using the App at any time by uninstalling it from your device. Upon uninstallation, all locally stored data will be removed. Data synced to Google Drive will remain in your Google Drive until you delete it manually.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to conflict of law principles.
