Terms of Service

These Terms of Service ("Terms") govern your use of the PenDate Notes application ("the App"). By installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By downloading, installing, or using PenDate Notes, you agree to these Terms of Service and our Privacy Policy. These Terms apply to all users of the App.

2. Description of the App

PenDate Notes is an offline-first note-taking and productivity application currently available for supported Android devices, iPhone, and iPad. The App allows you to create and organize text notes, handwritten drawings, checklists, events, and other personal content. The App can import events from supported device calendars where platform access is available and optionally supports cloud sync via Google Drive.

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to any systems or networks connected to the App
• Use the App to store or transmit malicious code or harmful content
• Redistribute, sublicense, or resell the App or any part of it

5. Google Drive Integration

The App offers optional cloud sync through Google Drive. By enabling this feature:

• You authorize the App to access your Google Drive as described in our Privacy Policy
• Your use of Google Drive is also subject to Google's Terms of Service
• The App accesses only the files it creates in your Google Drive and a hidden app-data folder for sync metadata
• You can revoke Google Drive access at any time through the App's Settings or your Google Account permissions

6. In-App Purchases

PenDate Notes offers optional paid digital products through Apple App Store and Google Play. These products are one-time, non-consumable purchases and are not subscriptions. Prices, taxes, regional availability, payment processing, and billing records are managed by the storefront shown on your device.

• A planner-family purchase unlocks creation of that supported planner family for years 2026 through 2099. PenDate Pro unlocks only the products and scoped-export benefit expressly listed as included in the current catalog; it is not a promise that every future paid product will be included.
• Purchases are tied to the Apple App Store or Google Play account used to buy them. You can use Restore purchases on compatible devices signed in to the same storefront account.
• Android and iOS purchases do not transfer between stores. A Google Play purchase does not create App Store ownership, and an App Store purchase does not create Google Play ownership.
• An internet connection is required when a purchase, restore, or ownership reconciliation must be verified with the applicable store. A temporary verification outage does not by itself revoke existing locally known ownership.
• Refund requests, decisions, and payment reversals are handled under the applicable storefront's rules and applicable law. If Apple or Google reports that ownership was refunded or revoked, the App stops new use of the affected paid benefit. Documents you already created remain yours and continue to render, sync, and export through available free routes.

Nothing in these Terms limits any consumer rights that cannot lawfully be waived. For purchase or restore problems, contact pendate.notes@gmail.com and use the support or refund process provided by the storefront where you purchased.

7. Data and Backups

We strongly recommend using the Google Drive sync feature or regularly exporting important notes to maintain copies of your content.

8. Intellectual Property

The App, including its code, design, graphics, and documentation, is the intellectual property of PenDate Notes and is protected by applicable intellectual property laws. These Terms do not grant you any rights to use PenDate Notes trademarks, logos, or branding.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be available at all times or function without interruption
• The App will be free of errors, bugs, or defects
• Any data stored in the App will be preserved indefinitely
• The App will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PENDATE NOTES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

In no event shall the total liability exceed the amount you paid for the App (if any).

11. Updates and Changes

We may update the App from time to time to add features, fix bugs, or improve performance. We may also update these Terms. Continued use of the App after changes to these Terms constitutes acceptance of the updated Terms.

We will make reasonable efforts to notify users of significant changes by updating the "Last updated" date at the top of this page.

12. Termination

You may stop using the App at any time by uninstalling it from your device. Upon uninstallation, all locally stored data will be removed. Data synced to Google Drive will remain in your Google Drive until you delete it manually.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the publisher of PenDate Notes resides, without regard to conflict of law principles.
